CARH’s Broadcast Email—Legislative Alert

As CARH members know from previous Broadcast Emails and information CARH has sent on the coronavirus pandemic, the Centers for Disease Control (CDC) issued last year a temporary moratorium under Section 361 of the Public Health Service Act halting residential evictions to prevent the further spread of COVID-19. The emergency rule has prohibited owners of rental property from evicting residents for non-payment of rent due to loss of income from the coronavirus pandemic. The order has been extended several times during the past year, with the latest order set to expire tomorrow, July 31.  When the CDC issued its last extension, the agency indicated that this would be the last time that the order would be administratively extended.

CARH learned late last evening that the House of Representatives intends to extend the moratorium through legislative procedure through the end of 2021. The House will take up the bill as early as today!  CARH, together with several other housing groups, sent the attached letter last evening to all members of the House of Representatives, Senate, and key officials within the Biden Administration opposing this legislation. Should efforts to extend the moratorium be successful in the House, its future in the Senate is less certain.

However, it is important that CARH members email your Representatives and Senators as soon as possible outlining the negative impact that extending the moratorium would have on your properties. You can include the industry letter, but we would also encourage you to give specific examples of the impact that the moratorium has, and will continue to have, should it be extended.
